Employer Terms

Last updated: draft, not yet published

These terms apply when a business, household or person ("you", "the employer") asks Dial4Hire ("Dial4Hire", "we", "us") to find staff, whether through dial4hire.com, WhatsApp, phone or email. By sending us a hiring requirement you agree to them. Our Terms of Use and Privacy Policy also apply.

Our service

  • Dial4Hire is a recruitment and placement consultancy serving Delhi NCR: Delhi, Noida, Gurgaon and Faridabad.
  • You tell us the role, location, timings, skills and salary budget. We look for suitable candidates, share their profiles with you and help set up interviews.
  • You interview the candidates and decide whom to hire. The employment relationship is between you and the person you hire. Dial4Hire is not their employer unless we agree otherwise in writing.
  • It is free to enquire. We aim to give a first response within 24 hours.
  • We never charge candidates for a job or placement. Do not pass any of our charges on to candidates.

Engagement and fees

  • Any fee, its amount, when it is payable and how it is paid are as agreed in writing for each engagement.
  • Fees are subject to GST as applicable.
  • Any replacement arrangement, if offered, will be as agreed in writing for that engagement.
  • Late or unpaid fees may lead us to pause or stop work on your requirements.

Your responsibilities as an employer

  • Give accurate and complete information about the role, salary, working hours, location and working conditions, and tell us promptly if anything changes or the position is filled.
  • Pay at least the applicable minimum wage and all wages on time, and follow the Code on Wages, 2019 and other applicable labour laws.
  • Provide a safe and healthy workplace, and meet your duties under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 where it applies.
  • Do not discriminate against candidates on the basis of religion, caste, sex, gender identity, disability, place of birth or any other ground prohibited by law.
  • Meet your own statutory obligations for anyone you hire, such as appointment letters, EPF, ESI, professional tax and TDS, where they apply.
  • Do not ask candidates for money, deposits or original documents as a condition of being hired.
  • Do not hire minors in violation of the Child and Adolescent Labour (Prohibition and Regulation) Act, 1986.
  • Dial4Hire carries out ID verification of candidates. You remain responsible for your own background, reference and suitability checks. ID verification is not a guarantee of a candidate's conduct.

Candidate information

  • Candidate profiles we share contain personal data protected by the Digital Personal Data Protection Act, 2023.
  • Use it only to assess the candidate for the role you asked us to fill. Do not share, sell or publish it, or use it to contact candidates for any other purpose.
  • Keep it secure and delete it when it is no longer needed for that hiring decision, or when we or the candidate ask you to.
  • Tell us without delay if candidate data we shared with you is lost, leaked or misused.
  • Our Privacy Policy explains how we handle personal data, including the contact details you give us.

No guarantee of hire

  • We make reasonable efforts to find suitable candidates, but we do not guarantee that we will find a candidate, that a candidate will accept an offer, join or stay, or how they will perform.
  • Candidates' information comes from the candidates. We do not guarantee that it is accurate unless we have agreed in writing to check something specific.

Direct hiring and non-solicitation

  • If you hire, directly or through someone else, a candidate we introduced to you within 1 month of the introduction, the fee for that hire applies as agreed in writing for the engagement.
  • Please tell us when you make an offer to, or hire, a candidate we introduced.

Limitation of liability

  • To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, or for a candidate's acts, omissions, conduct or performance.
  • To the extent the law allows, our total liability for any engagement is limited to the fees you actually paid us for that engagement.
  • Nothing in these terms limits liability that cannot be limited by law.

Ending an engagement

  • You may cancel a hiring requirement at any time by telling us. Fees already earned under the written agreement for that engagement remain payable.
  • We may stop working on a requirement if you break these terms, give false information, do not pay agreed fees, or ask for anything unlawful or discriminatory.
  • The sections on candidate information, fees, direct hiring, liability and governing law continue after an engagement ends.

Changes

We may update these terms. We will change the "Last updated" date. Engagements already agreed in writing keep the terms agreed for them.

Governing law and disputes

These terms are governed by the laws of India. Courts in Delhi have exclusive jurisdiction. We will first try to resolve any dispute through good-faith discussion.
